How can I go about getting a lawyers assistance with paperwork for an out of state divorce?

I am currently in the process of a dissolution with my ex. I live in Ohio, and she and my 3 small children live in Florida. I am trying to find assistance with filling out all the proper paper work, and possibly even getting representation. But all the attorneys I have contacted are not willing to assist with me because it is an out of state case. To make a long story short, she is the kind of woman who uses our kids in a game to try to hurt me. She filed an injunction so that I cannot take them out of the state of Florida, even after we both agreed they can come spend summer, Christmas, and Spring breaks with me and both of our families back here in Ohio. So until every thing is finalized, I am stuck with her withholding my children from me. Any information you can provide me with would be greatly appreciated, as the more time that goes by with out me being able to see my kids, the more I can feel like I am dying inside. INSURANCE POLICY DOESN’T ALWAYS COVER AGAINST LAWSUIT

Sometimes when a lawsuit is filed against you, your insurance company will provide you with an attorney to represent you but indicate that this is an “excess claim” and that it is defending you under a “reservation of rights”. An excess claim is one in which the amount sought exceeds the policy limits. In such a situation, you are responsible for any amount awarded in excess of your policy limits.

A reservation of rights means that your insurance carrier is reserving its right to deny coverage and to withdraw its defense in the matter. This may be because it believes you are insured for one of the claims against you but not for others.

For example, if you sell and install a built-in oven that later explodes and injures someone, you may be sued for negligent installation and a breach of warranty. Your insurance carrier may believe you have coverage for the negligence claim but not for the warranty claim and thus will defend under a reservation of rights. If you win on the negligence claim and lose on the warranty claim, your insurance company may deny coverage.

If a claim for punitive damages is included in the lawsuit, your insurance company will usually indicate it is not responsible for that portion of the claim.

Another reason your insurance company may reserve its rights to deny coverage is if it thinks you may have provided false or misleading information on your application for insurance, such as failing to inform them that you install the ovens you sell.

Sometimes it is unclear whether your policy covers the type of claim being made against you. Your insurance carrier may choose to defend you because if it fails to do so and you lose, it would be responsible for the judgment if a court subsequently rules that the policy did provide coverage in this area.

When your insurance company indicates that you have less than full coverage and/or it is defending under a reservation of rights, your interests may be diametrically opposed to your insurance company’s. While both of you hope that you win the case outright, your insurance company wants the matter to be settled or resolved outside of your coverage. You, of course, want it to be settled or resolved within your coverage.

While the attorney provided by your insurance company represents you on the claims against you, he or she cannot get involved in the coverage issues raised by your insurance carrier.

It is wise to consult your own attorney at the outset to represent you on the coverage issues. Your attorney can negotiate with your insurance carrier to settle the claim within your policy limits so that you do not run the risk of being liable for any award in excess of your policy limits. If you insurance company acts in bad faith and fails to settle the matter within your policy limits, it may become responsible for the excess amount, as well.

Your own attorney may also suggest that you reject the reservation of rights and force your insurance company to either defend without any limitations or to deny coverage.

If the insurer denies coverage and refrains from providing you with an attorney, it runs the risk of being responsible for the judgment if another court ultimately rules that your policy covered you against the claim. If either you or your carrier do not like this element of risk a separate suit on the policy (a declaratory judgment action) may be immediately filed by either of you seeking a judicial determination as to whether there is coverage and if so, where the coverage lies.

When you receive a letter from your insurance company indicating that the claim is in excess of your coverage or that it is defending under a reservation of rights, you should contact your own attorney immediately so that crucial strategic decisions can be made early on. If you wait until the case against you is ultimately resolved, it may be too late.

So we hurried up and threw a small backyard wedding. Eight months later he never made any further effort to joining the air force. He took passed asvab and then stopped trying. He is a terrible husband and a terrible husband. I'm only 20 and want to be rid of him and start my life new. I'm graduating college in a few months and feel annulment would be a better choice. I plan on talking with my uncle who is a paralegal for a divorce attorney but haven't been able to get in contact with him yet. Do I even have a chance of getting the annulment? I live in Indiana btw.

What’s the Difference Between: A Lawyer, Solicitor, Advocate, Barrister, Counselor, and an Attorney?

Have you ever wondered where all these somewhat confusing terms came from? Well the answer is they are all types of Lawyers originated from various legal systems. Some of the terms are from the English legal system, some are from Scotland and some from the American legal system.

An Attorney is somebody legally empowered to represent another person, or act on their behalf.

A Lawyer is somebody who can give legal advice and has been trained in the law.

Are Attorney and Lawyer are synonyms? Basically yes, but they are not necessarily Interchangeable terms, you cannot for instance say I give you the Power of a Lawyer, but you definitely might say I give you the power of Attorney…

Look again at the above definitions, does it now make any sense? Off course it does.

An attorney in fact is an agent who conducts business under authority that is controlled and limited by a written document called a letter, or power, of attorney granted by the principal. An attorney at law is an officer of a court of law authorized to represent the person employing him (the client) in legal proceedings.

A Solicitor- One that solicits, especially one that seeks trade or contributions. The chief law officer of a city, town, or government department but does not act as an advocate in court, as opposed to the Attorney who pleads in court. (English Law).

A Barrister(Called Advocate in Scotland) presents the case in court. Most senior and distinguished barristers are designated King’s (Queen’s) counsel.

A Counselor at law- In the past at least in some U.S states there was a distinction between the term A Counselor at Law who argued the case in court and an attorney who prepared the case but didn’t argue it.

Nowadays an attorney at law is authorized to exercise all the functions of a practicing lawyer. All of them must, however, like the ordinary attorney, be admitted to the bar. The term attorney is also used for county, state, and federal prosecuting officers, as county attorney, district attorney, and attorney general.

Lawyers, also called attorneys, act as both advocates and advisors in our society. As advocates, they represent one of the parties in criminal and civil trials by presenting evidence and arguing in court to support their client. As advisors, lawyers counsel their clients concerning their legal rights and obligations and suggest particular courses of action in business and personal matters. Although all lawyers are licensed to represent parties in court, some appear in court more frequently than others. Trial lawyers, who specialize in trial work, must be able to think quickly and speak with ease and authority. In addition, familiarity with courtroom rules and strategy is particularly important in trial work. Still, trial lawyers spend the majority of their time outside the courtroom, conducting research, interviewing clients and witnesses, and handling other details in preparation for trial.

Lawyers types:

The legal system affects nearly every aspect of our society, from buying a home to crossing the street. Lawyers hold positions of great responsibility and are obligated to adhere to a strict code of ethics.

The more detailed aspects of a lawyer’s job depend upon his or her field of specialization and position. Although all lawyers are licensed to represent parties in court, some appear in court more frequently than others.

Lawyers may specialize in a number of different areas, such as bankruptcy, probate, international, or elder law. Those specializing in environmental law, for example, may represent public-interest groups, waste disposal companies, or construction firms in their dealings with the U.S. Environmental Protection Agency (EPA) and other Federal and State agencies. These lawyers help clients prepare and file for licenses and applications for approval before certain activities may occur. In addition, they represent clients’ interests in administrative adjudications.

Some lawyers concentrate in the growing field of intellectual property, helping to protect clients’ claims to copyrights, artwork under contract, product designs, and computer programs. Still other lawyers advise insurance companies about the legality of insurance transactions, writing insurance policies to conform with the law and to protect companies from unwarranted claims.

Most lawyers are found in private practice, where they concentrate on criminal or civil law. In criminal law, lawyers represent individuals who have been charged with crimes and argue their cases in courts of law. Attorneys dealing with civil law assist clients with litigation, wills, trusts, contracts, mortgages, titles, and leases. Other lawyers handle only public-interest cases—civil or criminal—which may have an impact extending well beyond the individual client.

These issues might involve patents, government regulations, and contracts with other companies, property interests, or collective-bargaining agreements with unions.

Other lawyers work for legal-aid societies—private, nonprofit organizations established to serve disadvantaged people. These lawyers generally handle civil, rather than criminal, cases. A relatively small number of trained attorneys work in law schools.

The public perception of lawyers is that they make a lot of money each year and are very wealthy.

Isn’t it common knowledge that they all drive expensive foreign cars, are members of exclusive country clubs and wear expensive suits? I mean after all… anyone who is raking in $150…$250…$350…or even $500 per hour has got to be loaded. Don’t you think?

The reality is most lawyers end up dead broke. Surprised? I’m not. Especially when you consider the fact that most attorneys have no clue when it comes to making money, managing it and keeping it.

Why?

Because, no one ever taught them how.

They all went to college… then graduated from law school and headed directly into a law firm to practice law. This seems pretty straightforward, doesn’t it? I mean, it’s kind of what you would expect them to do

The challenge is… that in those 7-years of advanced education (4 in college and 3 in law school) they were never taught how to look out for themselves financially. Instead they were learning how to help you and me. This is great for us…but in the process they short-changed themselves and their families.

Most lawyers are working long hours (55+ per week), often including weekends.

And…

The reality of those high hourly rates they charge is this…very little of those rates trickle down to them- like maybe 10-15%. The majority goes to paying overhead. Which even is a tiny solo practice can be high when you include the costs of rent, malpractice insurance, phones, computers and software, advertising, secretarial, research library, paralegals, accounting, billing, and collections… and it goes on and on.

On top of all that, you can throw in clients who are completely unappreciative of their lawyer’s work and then to add insult to injury…lawyers deal with clients don’t pay their bills on time or at all. Just when you thought it couldn’t get any worse to practice as a lawyer…you have to deal with the endless issue of cash flow or lack of it.

Is it any wonder that all lawyers don’t end up dead broke?

If you think you may be headed down this road…Do Something about it today! It doesn’t have to be this way.

If you are thinking about filing for divorce or your spouse already has, knowing the divorce process can be very helpful in making the already devastating experience a little easier for you. Each states divorce laws lay out the divorce process and what legal requirements must be met. Even though every state’s laws are different, they all follow a basic guideline. Every divorce has its own unique circumstances that affect and alter the process itself. Legal separation is not an option is all states. States that do not support separation consider you and your spouse to be married until the divorce is finalized by the court. Divorce attorneys will file a petition for a separation agreement if the state you reside in recognizes legal separation.

The first step in the divorce process is filing a petition for divorce. The document itself can be called an Original Petition for Divorce or a Letter of Complaint and is generally filed with a local court clerk. This document requests the court to grant a divorce. Any relief the filing party feels they deserve is also listed along with the parties and children involved. A reason must be stated as to why a divorce is being filed for. The most common reason is irreconcilable differences. This document is served to the non-filing party by the local sheriff’s office and they have thirty days to respond. At this time either spouse may request restraining orders or temporary child support orders.

During the discovery stage, all information about marital assets, alimony, children, and any other matters is collected. Attorneys for each party request specific information by sending a list of items that must be responded to within thirty days. This process is often referred to as disclosures. Interrogatories are a list of questions that may be sent and responded to within thirty days as well. The opposing party must either deny or admit to a list of facts that is often called admissions of fact. Legal documents may be requested such as bank statements. Any document can be requested that your attorney feels will be beneficial. The final part of discovery is called deposition and involves getting sworn testimony from your spouse and all witnesses. Testimonies given during deposition can be used in court if a settlement is not possible.

Mediation is the next step and can be the end of the divorce if you both can come to agreement on all conflicts. Both attorneys and parties meet to go over the conflicts and attempt to reach an agreement that satisfies you both. The case goes to trial if an agreement is not reached. A trial date will be set for divorce court and the arguments will be presented to a judge. The judge examines the evidence and decides the appropriate settlement of all issues. When a decision is reached, each of you will sign a divorce decree stating who gets what assets, custody orders, and the amount of child support or alimony due. The decision can be appealed if you feel the decision was unfair. Lawyers can help with the appeal if you request it.

Most divorce lawyers want you to know the basic divorce process so you can provide them the information they need for the case and be ready for what follows. The divorce process consists of three main stages that involve obtaining information, mediating, and trial. Your divorce lawyer deals with all the legal details every day but may not be able to fully prepare you for what is going to happen. I am trying so hard to move one with my life but I am trapped because I cant afford financially what is needed to get a divorce. Most lawyers want $800 just to start. I am basically broke. Are there any lawyers that will represent for free? I tried legal services and that didn't work.

There is property and assets involved. And child support and alimony that I am entittled too.
